A High
Court in Lagos has dismissed the action brought by Statoil against Nigerian
business man, John Abebe. Justice Adefowope-Okojie said the action lacked
merit and constituted an abuse of process given that the court lacked the
jurisdiction to hear the case. This suit was the latest in the long
running saga between Dr John Abebe's company, Inducon Nigeria Limited, and the
Norwegian exploration and production company, Statoil.
Previously, the Court of Appeal
had dismissed the appeal filed by Statoil against an earlier High Court
judgment in favour of Abebe, in which Statoil was ordered to pay Abebe's
company 1.5% of its accrued profit in respect of the three oil blocks it had
been awarded. It is understood that this could amount to $3 billion. In that
decision, Justice Ogunwumiju, delivering the judgment of the Court of Appeal,
held that the payment was due to the company as it was responsible for bringing
the Norwegian firm to Nigeria.
Statoil was represented was represented by Fidelis Oditah (SAN) whilst Abebe was represented by Uche Nwokedi (SAN).
